Van den Briel (4 oktober 1940 gevangen genomen, om welke reden wordt niet vermeld) en na enige tijd tot 16 maanden tuchthuis straf veroordeeld, wordt begin 1941 naar Bochum overgebracht, waar hij tewerkgesteld wordt als boekbinder. In hun woonplaats Heemstede zet zijn vrouw met hun twee dochtertjes het leven voort. Zij vrouw doet, met een dienstmeisje, de huishouding. In februari 1942 wordt hij vrijgelaten en vat, na een "tweede huwelijksreis" met zijn vrouw, zijn werk op een notariskantoor in Amsterdam weer op. Het gezin leidt een niet ongezellig leven met familie en kennissen in hun Heemsteedse buurtje. Als in de zomer van 1943 de reserveofficieren zich moeten melden, duikt van den Briel onder in Amsterdam, maar komt, vooral later, vrij veel thuis. Eind maart verhuist hij naar een gewone huurkamer in Amsterdam, eind december komt hij weer thuis wonen, werkt eerst gedeeltelijk te Amsterdam, gedeeltelijk op een ander notariskantoor in zijn woonplaats, later i.v.m. het gevaar voor razzia's bij het reizen, uitsluitend op het laatste.
Zij leven ruim. Ze houden van muziek. Ze zijn tegen de Duitsers en NSB´ers en verontwaardigd over de jodenvervolging. Oranjegezind; Zo nu en dan kerkbezoek.Later is hij chef van de sectie geheime militaire inlichtingendienst van de N.B.S.( Nederlandse Binnenlandse Strijdkrachten) te Heemstede
